Terms And Conditions

1. Acceptance of Terms

By accessing or using the facilities and services of ShopHoistRentals.ca ("the Company"), clients ("Users") agree to comply with and be bound by these Terms and Conditions. If a User does not agree to these terms, they should not use the Company's services.

2. Eligibility

Users must be at least 18 years old to rent and use the Company's facilities and equipment. Proof of age may be required upon request.

3. Reservations and Payments

• Booking: Reservations for shop space and equipment must be made in advance through the Company's designated booking system.

• Payment: Full payment is required at the time of booking. Accepted payment methods include Visa and MasterCard.

• Cancellation Policy: Cancellations made more than 3 business days prior to the scheduled booking will receive a full refund. Cancellations made within 3 business days of the booking will forfeit the payment.
   

4. Liability Waiver

• Assumption of Risk: Users acknowledge that using automotive repair equipment and facilities carries inherent risks, including but not limited to personal injury, death, or property damage. By using the Company's services, Users voluntarily assume all associated risks.

• Release of Liability: Users agree to release, waive, and discharge the Company, its owners, employees, and agents from any liability, claims, demands, or causes of action arising from the use of the facilities and equipment, including any such claims resulting from the Company's negligence.
   

5. User Responsibilities

• Knowledge and Competence: Users attest that they possess the necessary knowledge, skills, and experience to safely operate the equipment and perform automotive repairs.

• Damage and Cleanliness: Users are responsible for any damage to the facilities or equipment resulting from misuse or negligence. Users must leave the workspace clean and swept after use. Failure to do so may result in additional cleaning fees.

• Compliance with Laws: Users must comply with all applicable local, provincial, and federal laws and regulations, including environmental regulations related to the disposal of hazardous materials.
   

6. Prohibited Activities

• Unauthorized Repairs: Users may only perform repairs on vehicles they own or have explicit permission to work on.

• Substance Use: The use of alcohol, marijuana, or any impairing substances on the premises is strictly prohibited. Violation will result in immediate termination of the session without refund.
   

7. Insurance

Users are responsible for maintaining appropriate insurance coverage for their vehicles. The Company does not provide insurance for Users' vehicles or personal property.

8. Indemnification

Users agree to indemnify and hold harmless the Company, its owners, employees, and agents from any claims, damages, losses, or expenses arising out of the User's use of the facilities and equipment, including claims brought by third parties.

9. Termination of Use

The Company reserves the right to terminate a User's access to the facilities and equipment without notice if the User violates these Terms and Conditions or engages in unsafe or inappropriate behavior.

10. Amendments

The Company reserves the right to modify these Terms and Conditions at any time. Changes will be effective upon posting on the Company's website or notification to Users.

11. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the Province of Manitoba and the federal laws of Canada applicable therein.

12. Severability

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

13. Entire Agreement

These Terms and Conditions constitute the entire agreement between the User and the Company regarding the use of the facilities and equipment and supersede all prior agreements or understandings, whether written or oral.

14. Acknowledgment

By using the Company's services, Users acknowledge that they have read, understood, and agree to be bound by these Terms and Conditions.
